PRIVACY STATEMENT

We value your data and privacy. This policy will explain how we collect and use your personal data and why we do this. This Privacy Policy relates to your use of our website, which is powered by Shopify, and any data collected about you through our online website.  For the purposes of data protection this policy refers to the 1998 Data Protection Act until 25th May 2018 and thereafter the EU General Data Protection Regulation (GDPR) or any subsequent, and successor, legislation.  

Timeout Bags is the data controller of the personal information we hold about you. This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from www.timeoutbags.com (the “Site”).  When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information.

SECTION 1 - WHAT PERSONAL INFORMATION DO YOU COLLECT ABOUT ME?

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information”. We collect Device Information using the following technologies:

- “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.

- “Web beacons”, “tags”, and “pixels” are electronic files used to record information about how you browse the Site.

Additionally when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, email, shipping address, billing address, payment details, company name, phone number and IP address. We refer to this information as “Order Information”.

Email marketing: With your permission, we may send you emails about our store, new products and other updates.

Delivery: We also enter your email address and telephone number into the order tracking facility of the method of delivery that you have chosen for your parcel.  The reason we do this, is to keep you fully informed about where your parcel is, so that we can provide you with updated information about your order.  You will be contacted by email or SMS to let you know tracking details about when your parcel will arrive.  Hermes or DPD only use your email address / telephone number to provide the tracking service relating to your order and do not pass your information to any third party.  Should you wish to find out more about Hermes and DPD company privacy policies you may wish to visit their websites for further details.

When you place an order through the Site, we will maintain your Order Information for our records in our online database unless and until you ask us to delete this information.  All data is stored on our website and we do not keep hard copies of your order details anywhere else, apart from what is held online in the customer order history.

SECTION 2 - WHAT DO WE DO WITH THIS INFORMATION?

Shopify provide us with the online e-commerce platform that allows us to sell our products and services to you. Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.  We use two factor authentication to access our database and customer order history.

We also use Google Analytics to help us understand how our customers use the Site -- you can read more about how Google uses your Personal Information here: https://www.google.com/intl/en/policies/privacy/. You can also opt-out of Google Analytics here: https://tools.google.com/dlpage/gaoptout.

We use the Order Information that we collect to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to:

- Communicate with you;

- Screen our orders for potential risk or fraud; and

- When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

If you opt into Shopify Pay, we store and use this information to pre-fill your checkout information. We additionally use this information to help customize and improve your experience when you visit a merchant store by presenting to you goods and service that are more likely to be of interest to you.

SECTION 3 - HOW DO YOU GET MY CONSENT?

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

To comply with the General Data Protection Regulation (GPDR), customers must opt in and ‘accept’ marketing in order for us to be able to use your email address for marketing purposes. There is a clear opt in tick box at checkout which customers can select if they would like to hear from Timeout Bags which can be ticked at checkout. We do not pass your email address to any other party and you can unsubscribe from emails at any time by clicking the link in the bottom of the email.

If you have actively ticked the ‘accepts’ marketing box or signed up to our newsletter, your customer details are automatically imported into our partner 3rd party website MailChimp. MailChimp is a marketing automation platform that allows us to share email campaigns with our customers.  

Your marketing contact details are stored on a MailChimp server under a EU-US Privacy Shield based agreement which is GDPR compliant.  In order for us to access the data held on MailChimp we use 2 factor authentication to ensure our database is secure.

Your data is not stored anywhere else apart from where is listed in this Privacy Policy.  Personal data processed for any purpose shall not be kept for longer than is necessary for that purpose. We value your privacy and we update, archive or securely delete information if it goes out of date.

SECTION 4 - HOW ARE MY PAYMENTS PROTECTED?

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SECTION 5 - WHAT SECURITY DO YOU HAVE IN PLACE TO PROTECT MY DATA

To protect your Personal Information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption.  Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

SECTION 6 - THIRD PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements. Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

Lastly, we may disclose your personal information to a third party if we are required by law to do so or if you violate our Terms of Service.

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.  If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
